\n On\u00a0May 26, 2022. PGE G\u00f3rnictwo i\u00a0Energetyka Konwencjonalna S.A. issued a\u00a0debit note in\u00a0the amount of PLN 561,516,981.74 to\u00a0the consortium of Mitsubishi Power Europe Gmbh,\u00a0 Tecnicas Reunidas S.A. and Budimex S.A. Budimex S.A.\u2019s share in\u00a0the consortium does not exceed 24% of the contract value. <\/strong>
\n Budimex S.A. considers the calculation of the above-mentioned penalty by\u00a0the contracting authority to\u00a0be\u00a0unjustified, and the debit note will not be\u00a0included in\u00a0the company\u2019s books.<\/strong>\n <\/p>\n

The consortium completed the investment in\u00a0accordance with the requirements of the contracting authority, which was confirmed by\u00a0the commissioning of the unit. The note received concerns the warranty period. During this period of operation, there were scheduled and unscheduled inspections of installations, which were agreed with the contracting authority. The above was not the fault of the contractor.<\/p>\n

The consortium was obliged to\u00a0apply individual solutions, agreed with the contracting authority, to\u00a0meet the highest EU\u00a0standards related to\u00a0environmental protection. In\u00a0addition, it is worth noting that the inspections took place during a\u00a0difficult period related to\u00a0the pandemic. These difficulties were temporary and the consortium exercised due diligence to\u00a0overcome them.<\/p>\n

It should be\u00a0emphasised that the scope of work carried out by\u00a0Budimex S.A. did not affect the availability of the unit, which was contested by\u00a0the contracting authority. The Company was not responsible for the supply of key technological equipment responsible for electricity generation.<\/p>\n

In\u00a0addition, Budimex S.A. points out that in\u00a0accordance with Art. 15r(1) of the Act on\u00a0Special Solutions Related to\u00a0Preventing, Counteracting and Combating COVID-19, Other Infectious Diseases and Crisis Situations Caused by\u00a0Them, the Contracting Authority may not deduct the contractual penalty from the contractor\u2019s receivables during the state of epidemic threat and within 90 days from the date of its cancellation,or satisfy their claims in\u00a0terms of penalties from the performance bonds.<\/p><\/div>\n <\/div>\n <\/div>\n <\/div>\n<\/section>","protected":false},"excerpt":{"rendered":"
